Can tenants demand energy refurbishment?

If there is a defect in the rented property, the tenant can demand that the landlord repair it or reduce the rent. For example, in the case of leaky windows and a resulting high heating bill.

The situation is different if a high heating bill is not caused by a defect, but the tenant lives in an old flat with outdated insulation. The tenant has no legal means to demand an energetic renovation. The tenant is entitled to make such a request to the landlord at any time.

In the case of such a request, it may make sense for the landlord to talk to the tenant and explain the cost implications of an energy-efficient renovation. The service charge bill would be lower as a result, but the landlord would have the right to raise the net rent due to the refurbishment. However, it is quite possible that the improved living comfort and the protection of the environment are worth a higher rent to a tenant.

The tenant is advised to be aware of the possible cost implications before approaching the landlord and requesting an energy retrofit.
