Dieses Jahr kann oder will sich das Ihre Firma nicht leisten. Ihr Arbeitnehmer ist damit nicht einverstanden und verlangt von Ihnen einen Bonus. Kann er dies?<\/p>\n\n\n\n<p>Bei tiefen bis h\u00f6heren Einkommen kann ein regelm\u00e4ssig geleisteter Bonus zu Lohn mutieren, wenn der Bonus neben dem Lohn nicht mehr zweitrangig beziehungsweise als ein regelm\u00e4ssiges Supplement erscheint. Der Arbeitnehmer kann diesen &#8220;Bonus&#8221; dann als Teil des geschuldeten Lohns durchsetzen. Der Vorbehalt, wonach der Bonus eine freiwillige Leistung sei, kann dies nicht in allen F\u00e4llen verhindern.<\/p>\n\n\n\n<p>Bei sehr hohen Einkommen (ab ca. CHF 350&#8217;000) bleibt der Bonus ein Bonus, er verwandelt sich nie in Lohn.
